A man who took photos of bikini-clad girls at Kaiteriteri Beach has been found guilty of indecency. Graham Thomas Rowe, 61, was found guilty in the Nelson District Court on Friday of doing an indecent act with intent to insult. The jury of eight women and four men took about two hours to reach a verdict. The charge is related to Rowe taking photos of three girls, believed to be aged 12-15, wearing bikinis at Kaiteriteri Beach on January 23 last year. The Crown's case is that Rowe's behaviour was "inappropriate, offensive and insulting" to the girls. It's alleged that Rowe knew his actions were wrong and intended to insult. Rowe, who regarded himself as a travel writer and photographer, admitted taking photos of the girls. He said he has been travelling the country taking photos for a South Island travel guide and believed he was legally entitled to take photos of people in public places. In his closing address, Crown prosecutor Sefton Revell said: "The reality is that creepiness is not a crime." He said it was up to the jury to set the standard of decency and suggested they take into account the age of the girls, the lack of consent, the location and the purposes of taking the photos. "I suggest there's a sexual motivation there because there isn't another explanation for it." Defence lawyer Rob Ord closed by saying that taking photos of teenagers who were "obviously happy to be in full public view in their bikinis" was not indecent. Rowe gave evidence on Friday. In cross-examination, Revell put to Rowe that the photographs of girls in bikinis were for his sexual enjoyment. "I strongly deny it," Rowe said. Rowe, who lives in the Nelson region, said he had been staying in his campervan near Kaiteriteri and drove to the beachfront on the morning of January 23. "I saw three girls in bikinis on the beach and I thought they looked attractive and looked like they were having fun," Rowe said. "Attractive to me personally, their looks, I enjoy all forms of attractiveness, all forms of beauty and that includes girls and young women, of course." Rowe said he took five photographs of the girls from a distance and without their consent. He said he was then approached by off-duty police officer, Sergeant Daniel Isherwood, who seized his camera, read him his rights and arrested him. The court heard that Rowe had a folder on his laptop computer called "girls" that contained sub-folders including blondes, Asians and others. Rowe said he later told Constable Dave Colville that he took photos of a wide range of things on his travels. He said some were for the travel book he was working on and others for "my own enjoyment". "I didn't mean anything sexual by that or anything malicious." He said he had read on the police website that there is "no expectation of privacy" at a public beach. Rowe said if the girls in photographs were identifiable they wouldn't be used in the travel guide. "They would just remain in my collection of attractive, beautiful things." Rowe was before the court twice in 2005, facing similar charges. In the first case, he was found guilty of offensive behaviour for taking pictures of girls walking to school along public roads, according to a report at the time. Rowe photographed them from inside his van and was found to have more than 100 rolls of films of girls aged 10-15. In the second case, he was found with 13 images on his laptop, all of young women studying in the Otago University.
